第1条（適用範囲）

本利用規約は、EXART Global Storeをご利用になるすべてのお客様に適用されます。

第2条（禁止事項）

以下の行為を禁止します。

・不正注文、なりすまし

・知的財産権の侵害

・ストア運営の妨害

・不正または無権限の決済行為

第3条（受注生産・注文確定）

EXART製品は受注生産品です。

ご注文確定後のお客様都合によるキャンセル・変更・返品は原則としてお受けできません。ただし、適用法令に基づくお客様の権利を制限するものではありません。

第4条（法令への適合）

排ガス、騒音、公道使用等に関する法規制は国・地域によって異なります。

海外の法規制への適合は保証しておりません。製品によっては使用地域の法令上、競技用または公道使用不可となる場合があります。

お客様には、ご購入・ご使用前に車両適合および使用地域の法令をご確認いただく必要があります。

第5条（製造国・認証）

EXART製品は日本国内で製造されています。

JQR認証等の日本国内における認証は、該当する日本の保安基準に関するものであり、CARB、EPA、EUの関連規制など海外の法規制への適合を保証するものではありません。

第6条（取付けと使用）

製品の取付けは、専門の整備事業者・技術者にご依頼ください。

誤った取付け、整備不良、他社部品との干渉、車両固有の条件などに起因する損害については、適用法令に従って取り扱います。

第7条（間接損害）

逸失利益、営業停止、取付け・脱着工賃、代車・レンタカー費用、機会損失等に関する責任は、適用法令の定める範囲に従います。

第8条（税金・通関）

海外配送の場合、輸入関税、VAT/GST、通関手数料、検査・保管料等は原則として購入者の負担となります。

通関手続きによって配送に遅延が生じる場合があります。

第9条（配送中の危険負担）

運送会社への引渡し時に危険負担が購入者へ移転する旨の取引条件については、適用法令の定めが優先されます。

配送中の遅延、紛失、損傷等についても、適用法令に従って対応いたします。

Article 1 — Scope

These Terms of Service apply to all customers using EXART Global Store.

Article 2 — Prohibited Conduct

Customers must not engage in:

・Fraudulent orders or impersonation

・Intellectual property infringement

・Interference with store operations

・Unauthorized or fraudulent payment activity

Article 3 — Made-to-Order Products

EXART products are made to order.

Cancellations, changes, and returns for a change of mind are generally not accepted once an order has been confirmed. This does not limit rights provided under applicable law.

Article 4 — Regulatory Compliance

Emissions, noise, and road-use regulations vary by country and region.

We do not guarantee compliance with foreign regulations. Certain products may be classified as competition-use or off-road-only products under applicable local laws.

Customers must verify vehicle compatibility and legal requirements before purchasing or using any product.

Article 5 — Manufacturing and Certification

EXART products are manufactured in Japan.

Japanese certifications, including JQR approval where applicable, relate to Japanese regulatory requirements and do not establish compliance with foreign regulations, including CARB, EPA, or EU requirements.

Article 6 — Installation and Use

Products should be installed by a qualified technician or professional workshop.

Liability for damage arising from improper installation, incorrect maintenance, interference with other components, or vehicle-specific factors is subject to applicable law.

Article 7 — Indirect Losses

Liability for indirect or consequential losses, including lost profits, business interruption, installation or removal costs, replacement vehicle expenses, and lost opportunities, is subject to applicable law.

Article 8 — Taxes and Customs

For international shipments, import duties, VAT/GST, customs fees, inspection charges, and storage fees are generally the responsibility of the buyer.

Customs procedures may cause delivery delays.

Article 9 — Transfer of Risk

Any contractual transfer of shipping risk upon handover to the carrier is subject to applicable law.

Claims relating to shipping delays, loss, or damage will be handled in accordance with applicable legal requirements.
